Terms Of Service

  1. These general Terms and Conditions ("Terms and Conditions" or "T&C") shall be valid for all request for refund offered by 9jaCashback and its vehicle company MachinePush Nigeria limited (a company duly organized under the laws of Nigeria, with business registration RC 1035305.
  2. 9jaCashback shall offer request for electronic transaction refund services through various channels not limited to ATM ,Web POS, SMS, USSD hereon referred to as ‘the service".
  3. By using the service you are bound by the following terms and conditions:
  4. All the terms and conditions listed in this page shall together be referred to as "the Terms of Use". "User" and "Customer", "You" and "Your" refers to you, the person accessing the Service and accepting the Company's terms and conditions. Whenever the Customer uses the service such as to request a refund or to participate in any of the promotions offered, he agrees to be bound by the Terms of Use, including any amendment which may periodically take place.
  5. The Terms and Conditions contained herein represent the complete, final and exclusive agreement between the Customer and the Company and supersede and merge all prior agreements, representations and understandings.
  6. By using the service the Customer confirms that he/she has reached the age of 18 or such legal age as he/she must have reached under the laws governing electronic financial transactions that are applicable to him/her. Irrespective of national regulations concerning the legal age, however, 9jaCashBack does not accept any Users under the age of 18. 9jaCashback reserves the right to verify any Customer's statement of age and to exclude Customers from its services, if there are any doubts regarding the attainment of the minimum age required. Any Customer using our services, who is identified as underage , shall have all his refunds forfeited and his/her refund wallet (hereinafter referred to as the "Account" shall be deactivated immediately)
  7. Non-Commercial, non-professional purposes: the Customer´s interest in using the service is of a personal nature, and is to be used purely for personal refunds interest . Any commercial and professional interest is discarded.
  8. 9CashBack does not warrant the constant availability and functionality of all types of refunds offered by 9CashBack . 9jaCashback may not be held liable and will be held harmless by the Customer for any damages, losses, costs, loss of profits or any other disadvantage a Customer may incur in connection with any disconnection from or the non-availability of any level of request for refund services offered by 9jaCashback for whatever reason.
  9. 9jaCashBack cannot be held liable in any case for any damage or loss caused directly or indirectly by the service or by its contents unless they are based on intentional or gross negligence.
  10. All indicated request & refunds dates and times are based on WAT (West Africa Time) unless stipulated otherwise.
  11. Any exception to the existing Terms of Use will be communicated in written form to the Customer. Any verbal statement made by any 9jaCashBack employees or affiliates will not be considered in case of a dispute.
  12. The request offer and contract, as well as any other legal relationship between the Customer and the Company, for every circumstance not regulated by the Terms of Use, is subject to Nigerian laws.
  13. All request for refunds and refunds service are available in Nigerian Naira (NGN) only.
  14. Any exception to the existing Terms of Use will be communicated in written form to the Customer. Any verbal statement made by any 9jaCashBack employees or affiliates will not be considered in case of a dispute.

1.0 ELIGIBILITY

To be eligible you must (i) possess and operate a valid Nigerian Bank account replete with a valid electronic debit or credit card. You must, at the time of registration (i) be at least eighteen (18) years of age or the age of majority in your Jurisdiction of residence, whichever is greater, (ii) be physically located in a state in the Federal Republic of Nigeria (iii) at all times abide by these Terms and Conditions of Use.


The Company reserves the right to verify your age, identity and eligibility at any time. Any failure to cooperate with the Company in this respect may result in the forfeiture or your winnings.


Employees, officers, directors, members, managers, investors, agents, and representatives of the Company and any of its or their parent companies, subsidiaries, affiliates as well as direct technology vendors, content providers, component suppliers (both hardware and software) directly related to the Promo, and each of their respective immediate family (defined as parents, spouse, partner, and children) and any person residing in the same household are not eligible to use the Service. Such persons may, however, access the Service, and will from time to time do so for the purpose of testing the Service, including, without limitation, evaluating user experience, and other reasonable and fair uses at the sole discretion of the Company.


By accessing or using the Service, you represent and warrant that you have the right, authority and capacity to enter into this agreement, to abide by all of these Terms and Conditions of Use, and that you are not prohibited from accessing or using the Service. The Company makes no representations or warranties, implicit or explicit, as to your legal right to access or use the Service and no person affiliated, or claiming affiliation, with the Company shall have authority to make any such representations or warranties. The Company reserves the right to deny access to the Service to anyone at its sole discretion.

2.0 COMPLIANCE

You will comply with all of the terms and conditions of this Agreement and all applicable laws, regulations and rules when you use the Service. A User must be 18 years or older to participate in and the Service. These rules & policies are valid only where legal. You are responsible for ensuring that it is legal for you to enter the promo in your local jurisdiction. The Company reserves the right to cancel a user’s entry if behaviour is deemed unacceptable by Machine Push Nigeria Limited or any of our affiliates. In the event of any winnings generated from an account which is not in strict compliance of the present Terms and Conditions of Use, the rights to said winnings may be compromised.

3.0 NOTICE OF MODIFICATIONS OR CHANGES

The Company may modify the service at any time with or without notice to you. The Company and its content including, without limitation, the information, graphics, products, features, functionality, services, and links (collectively the “Content”) may be changed, deleted or updated without notice. Machine Push may discontinue, suspend or modify the Service at any time without notice, and the Company may block, terminate or suspend your access to the Service at any time for any reason in its sole discretion, even if access continues to be allowed to others.

4.0 AMENDMENTS TO THE TERMS OF USE

  1. The Terms of Use can be changed at any time by 9jaCashback at its own discretion. All changes will become effective on their publication on our website on any other official press release channel.
  2. If you consider any amend carried out to be intolerable, you may cease using the service.
  3. The continued use of the Service after the date when the Terms of Use are meant to come into effect will correspond to a complete acceptance of the revision performed, whether or not the changes have been acknowledged.

5.0 MANAGING A REFUND WALLET

  1. Each Customer who wants to have access to electronic transaction refund services refund services and products offered by 9jaCashBack must activate a CashBack refund Account via ATM or WEB or USSD. By activating a CashBack wallet and by placing a refund request, the User warrants that he/she has reached the minimum legal age for participation. In addition by activating a 9jaCashBack and by placing a request , the User confirms that he or she retains the legal capacity to enter into an agreement with the Company. If one of these conditions is not respected the User's refund wallet will be closed and all other necessary measures will be implemented.
  2. It is prohibited for Customers to buy, sell or transfer use of refund wallets to other Customers.
  3. When a new refund wallet is activated the Customer is responsible for the accuracy and up-to-datedness of all the personal information and contact details provided, including phone number
  4. Every Customer may only activate one refund wallet per ATM Card with us. 9jaCashBack retains the right to close the Refund Wallet of any user who has activated refund accounts under his/her name or under different names. with the intention of defrauding the Company, we retain the right to cancel any transaction related to the said fraud attempt.
  5. After opening an account the Customer must keep username, password and/or account number a secret as 9jaCashback or its associates company(s) shall not be liable for any claims in the event that the user gives away, tells, shares or loses his/her username, password or account number.
  6. In accordance with the legal period of warranty requested by law all the personal details saved in our system will only be deleted at your express request after the expiration of the respite period of seven (7) years.
  7. 9jaCashBack and its affiliates retains the right to exclude any User(s) from this services at its discretion. In this case we will refund the residual credit balance in the refund wallet account to the bank account used activate the wallet in question.. If the Account has been closed due to an infringement pursuant to the Terms of Use or to a prohibited behaviour leading to collusion, Fraud or whatsoever Criminal Activity, the residual credit balance may be forfeited.

6.0 FUNDING, REFUNDS AND WITHDRAWALS

  1. User(s) have the possibility to fund the credit balance of his refund wallet with one of the payment methods made available by 9jaCashBack. The Customer can similarly withdraw the residual credit balance using the same payment method provided upon activation.
  2. Withdrawals will be remitted only to the same bank account used to activate the Refund Wallet in question.
  3. All Refunds will be paid into activated CashBack Refund Wallet(s).
  4. All withdrawals from refund wallet to bank account will take 24- 48 hours to be finalised.
  5. All base refund limits are pegged at 20 Thousand Naira ATM and 10 thousand Naira only for POS except otherwise stated.
  6. .All Funds residing in the CashBack Wallet shall not attract any interest.
  7. All Request for refunds must be made before 11.55 Am & 11.55 Pm daily to be eligible for considerations for any of the daily time stamps
  8. Where applicable by law, the Company will subject the payment of any winnings to the statutory withholdings and / or deductions.
  9. A person may make as many request as they desire in a day.

6.0. LEGAL USE OF THE WEBSITE AND OF ITS COMPONENTS

  1. Under no circumstances shall the Service be used for any purpose different from personal fulfilment without our express consent. 9jaCashBack is not liable for any attempts to use the services offered by means or ways not intended by us.
  2. All Trademarks, Domains, Terms of Use, Logos, Images, operational process and any other material used by or in 9jaCashBack Electronic Transaction Refund Services (Ex. graphics, pictures, text etc.), as well as any other content or underlying idea that can be found within our Overall Processes, Website, are owned by 9jaCashBack and protected by copyright in their entirety and may not be modified, reproduced and redistributed, in whole or in part, without 9jaCashBack express previous written permission. All necessary legal actions will be undertaken in order to ensure compliance to this policy
  3. Any action aimed to interfere with the normal functioning of the website including, but not limited to, releasing or propagating viruses, worms or logic bombs or similar is strictly prohibited and will be pursued to the fullest extent permitted by law.
  4. 9jaCashback may at any time and without previous notice, remove or amend any the scale of refunds offered via the Website, as well as alter available refund percentages as the reality suggest.
  5. Under some circumstances 9jaCashBack may provide its Customers with software designed internally or by third parties in order to optimize the functioning of the refund process or to benefit from additional services. In such circumstances the Customer may be subject to the Terms and Conditions of the third party software owner(s) .
  6. 9jaCashBack is not liable for any possible IT failures caused by the electronic equipment used by the Customer while accessing the service via ATM, Web , SMS or USSD or for faults due to the network service provider used by the Customer while accessing the service.
  7. 9jaCashBack also assumes no liability for correctness, completeness or up-to-dateness of the information services provided neither for the accuracy of our random time stamps statistics and intermediate transaction data received from your bank

7.0.GIVEAWAYS/ BONUSES/ PROMOTIONS

  1. The Bonus Conditions form part of the General Terms and Conditions.
  2. We may in any moment offer you complimentary giveaways to be credited directly into your refund wallet.. Acceptance of any Giveaway results in implicit acceptance of additional terms and conditions we may make available to you in respect of each such bonuses, promotions and special offerings. 9jaCashBack reserves the right to withdraw in any moment any credited bonuses when a material infringement of the Terms of Use has been ascertained.
  3. 9jaCashBack reserves the right to deny admission or to terminate admission to any of the bonuses, promotions and/or special offerings, as well as to modify, suspend or discontinue their validity at its sole discretion and without informing the Customer.
  4. All giveaways and promotional offers are subject to the terms and conditions made available when communicating the such offer.

8.0. COMPLAINTS AND SUGGESTIONS

  1. If you wish to make a complaint or a suggestion regarding the Company, the Website or the services offered, as a first step you should contact our Customer Services or send us an email through support@9jacashback.com
  2. All claims and suggestions should be forwarded to the Customer Service in written form via internal message, fax, mail or e-mail. No complaints with regard to the acceptance, settlement or resettlement of a refund will be heard by us if they are not raised through our Customer Services within 30 days from the time stamp of such refunds.
  3. Offensive or rude language, as well as malicious or damaging comments, will not be tolerated while contacting our staff or while discussing our products and services in any media, social network or forum. Any infringement of this policy will result in a suspension of the Account or in every additional action as may be required in order to ensure compliance.

9.0 WAIVER

  1. In no event will any delay, failure or omission (in whole or in part) in enforcing, exercising or pursuing any right, power, privilege, claim or remedy conferred by or arising under these Terms and Conditions or by law, be deemed to be or construed as a waiver of that or any other right, power, privilege, claim or remedy in respect of the circumstances in question, or operate so as to bar the enforcement of that, or any other right, power, privilege, claim or remedy, in any other instance at any time or times subsequently.

10.0. MOBILE DEVICE & SERVICE CHARGES

For Users who will be opting in via the internet note that this may require communication with the Company’s servers, including, without limitation, which may consume data. You acknowledge and agree that you are solely responsible for any charges incurred with your data/mobile service provider as a result of use of this promo, including any overage and penalties assessed for exceeding the limits imposed by your service provider.


You are responsible for the cost of your Mobile Device and to ensure that your Mobile Device meets the system requirements apt for accessing this promo if you choose to access it from the web including obtaining periodic updates or upgrades from your Mobile Device service provider to continue accessing the web. THE COMPANY DOES NOT WARRANT OR GUARANTEE THAT WEB APP WILL BE COMPATIBLE OR FUNCTION WITH ANY PARTICULAR MOBILE DEVICE, NOR DOES THE COMPANY WARRANT OR ACCEPT ANY LIABILITY FOR OPERATION OF THE MOBILE DEVICE USED TO ACCESS OUR WEB or SMS/USSD APPLICATION.

The Company name, the Company logo and all related names, logos, product and service names, designs and slogans are trademarks of the Company or its affiliates or licensors. You must not use such marks without the prior written permission of the Company. All other names, logos, product and service names, designs and slogans are the trademarks of their respective owners.

12.0. PALPABLE ERRORS

The Customer has an obligation to inform 9jaCashBack as soon as possible of any amount wrongly credited on his/her wallet. 9jaCashBack may at any time set off any positive balance resulting from the erroneous operation, as well as cancel possible request or transactions made with the erroneously credited funds.

5. In the event of any dispute the Customer agrees that the records of our server shall act as the final authority in determining the outcome of any claim.

From time to time, the Company may in its sole discretion develop and provide updates, which may include upgrades, bug fixes, patches and other error corrections and/or new features/processes (collectively, including related documentation, “Updates”). Updates may also modify or delete in their entirety certain processes, features and functionality. You agree that the Company has no obligation to provide any Updates or to continue to provide or enable any particular features or functionality.

FURTHER, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR FAILURE OR DELAY IN PERFORMING AN OBLIGATION UNDER THESE TERMS AND CONDITIONS OF USE, INCLUDING BUT NOT LIMITED TO TR TICKETS OR COLLECTING WINNINGS, IF IT IS PREVENTED FROM DOING SO BY CAUSES BEYOND ITS CONTROL SUCH AS A FORCE MAJEURE EVENT OR THE ACTIONS OF ANY LOTTERY COMMISSION OR ORGANIZATION, OR ANY FEDERAL, STATE OR LOCAL GOVERNMENTS.

EXCEPT AS PROVIDED OTHERWISE IN THESE TERMS AND CONDITIONS OF USE, YOUR SOLE REMEDY FOR DISSATISFACTION WITH OR DAMAGE SUSTAINED IN CONNECTION WITH THE SERVICE OR THE CONTENT OFFERED THEREON IS TO STOP USING THE SERVICE. YOUR PERMISSION TO USE THE SERVICE MAY AUTOMATICALLY TERMINATE WITHOUT NOTICE AT THE COMPANY’S SOLE DISCRETION.

17.0. INDEMNIFICATION

You agree to defend, indemnify and hold harmless the Released Parties from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms and Conditions of Use or your use of the Service, including, but not limited to, any use of the Service’s Content and products other than as expressly authorized in these Terms and Conditions of Use or your use of any information obtained from the Service. If you are obligated to provide indemnification hereunder, the Company may, in its sole and absolute discretion, control the disposition of any claim at your sole cost and expense. Without limitation of the foregoing, you will not settle, compromise or in any other manner dispose of any claim without the Company’s written consent. If you are obligated to provide indemnification hereunder, the Company may withhold any payment it is otherwise required to make to you to offset your indemnity obligations.

18.0.GOVERNING LAW AND DISPUTE RESOLUTION

All matters relating to the Company, the Service, these Terms and Conditions of Use and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the Federal Republic of Nigeria without giving effect to any choice or conflict of law provision or rule.

19.0 LIMITATION ON TIME TO FILE CLAIMS

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS OF USE OR THE SERVICE MUST BE COMMENCED WITHIN 30DAYS (30) AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

20.0. TAX OBLIGATION

You acknowledge that you are responsible to report your income and pay any taxes due to the appropriate Federal, State and Local authorities in the Federal Republic of Nigeria and in the country you reside.

21.0 WAIVER AND SEVERABILITY

No waiver of by the Company of any term or condition set forth in these Terms and Conditions of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms and Conditions of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms and Conditions of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms and Conditions of Use will continue in full force and effect.

22.0.ASSIGNMENT

The Company may assign its rights and obligations under this Agreement, in whole or in part, to any person or entity at any time without notice to you and without your consent. Upon such assignment, the Company may be relieved of any further obligation hereunder. You may not assign or delegate any rights or obligations under these Terms and Conditions of Use without the Company’s prior written consent, and any unauthorized assignment and delegation by you is void and ineffective.

23.0. RELATIONSHIP OF PARTIES

You acknowledge and agree that no joint venture, partnership, or employment relationship exists between you and the Company as a result of this these Terms and Conditions of Use or your use of the Service. You agree not to hold yourself out as representative, agent, operator, distributor, or employee of the Company and the Company shall not be liable for any of your representations, acts, or omissions. You also acknowledge and agree that, except as otherwise expressly provided in these Terms and Conditions of Use, there shall be no third-party beneficiaries.

24.0. FORCE MAJEURE
